These Terms of Service ("Terms") govern your use of services provided by Souvenir Photograph ("we," "us," "our"), including the SP Photo Station platform, the customer photo gallery experience, and related text-message notifications. By providing your phone number, accessing your photo gallery, or using any of our services, you agree to these Terms.
If you do not agree to these Terms, please do not use our services.
We operate a platform that allows professional photographers and venues to capture photographs of customers and deliver them to those customers via a private gallery link sent by SMS. Customers may view, download (where permitted), and purchase products featuring their photographs.
Specific photographers, venues, and event operators are our customers — when you receive a gallery link from us, the photos were taken by an independent photographer or venue using our platform.
You must be at least 13 years old to provide your phone number and consent to receive a gallery link. If you are between 13 and the age of majority in your jurisdiction, you may use the service only with the involvement of a parent or guardian. Photographs of minors may be captured only when a parent or guardian is present and has consented.
By providing your mobile phone number and ticking the consent checkbox, you authorize Souvenir Photograph to send you a one-time text message containing the link to your photo gallery. Standard messaging and data rates from your carrier may apply.
You can reply STOP at any time to opt out of all text messages from us. Reply HELP for assistance. See our Privacy Policy for full details on SMS handling.
Message frequency: at most one (1) SMS per photo session. We do not send marketing or promotional messages.
Photographs captured at a venue and delivered through our platform remain the property of the photographer or venue who created them. We hold them on the photographer's behalf to deliver to you.
Your license to use photos. When you receive your gallery link or purchase a digital download, you receive a non-exclusive, non-transferable license to use those photographs for personal, non-commercial purposes (sharing on personal social media, printing for personal use, framing for your home, etc.). Commercial use (advertising, resale, stock photography licensing) requires a separate written license from the photographer.
Watermarked previews. Some photographs may display a watermark when viewed in the gallery. Removal of the watermark requires purchase of the print or digital download. Tampering with, removing, or obscuring the watermark on a preview is a violation of these Terms.
If you purchase prints, digital downloads, or other products through our platform, payment is processed by Stripe. By completing a purchase, you authorize the charge in the amount displayed at checkout, plus any applicable taxes and shipping.
Refunds. Digital downloads are non-refundable once delivered. Physical prints and merchandise are subject to the photographer's or venue's refund policy, which is displayed at checkout. Defective products (damaged in shipping, mis-printed, etc.) will be replaced or refunded — contact support@spphotostation.com within fourteen (14) days of delivery.
Shipping. Physical product fulfillment is handled by our print partners (typically WHCC). Estimated delivery times are shown at checkout and depend on the product, the destination, and the carrier.

We may suspend or terminate your access if you violate these terms, and may report illegal activity to the appropriate authorities.
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and share information about you. By using our services, you agree to the practices described in the Privacy Policy.
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Souvenir Photograph disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
Photographs are uploaded by independent photographers and venues. We do not guarantee the artistic quality, exposure, focus, or content of any individual photograph.
To the maximum extent permitted by law, Souvenir Photograph (including its officers, employees, and contractors) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the service.
Our total aggregate liability for any claim arising out of these Terms or your use of the service shall not exceed the greater of (a) the amount you paid us for the service in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Souvenir Photograph from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the service, or your violation of any third party's rights.
We may modify, suspend, or discontinue any part of the service at any time, with or without notice. We may also update these Terms from time to time; the "Effective" date at the top of this page reflects the most recent update. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect.
